What this is
A trademark is what stops a competitor trading under your name. Registration gives the proprietor the exclusive right to use the mark for the goods or services registered, and the right to sue for infringement rather than relying on the slower and harder action for passing off.
Marks are registered in classes under the Nice Classification — forty-five of them, thirty-four for goods and eleven for services. Protection extends only to the classes applied for, so a name registered for software is not protected against the same name used on clothing.
Filing is fast; registration is not. The application number and the ™ symbol are available within days, but examination, publication in the Trade Marks Journal, and the opposition period mean registration and the ® typically take twelve to twenty-four months.

Who can apply
Any person, firm, company or other entity claiming to be the proprietor of a mark, whether already in use or proposed to be used, may apply.
The mark must be capable of distinguishing your goods or services. Marks that are purely descriptive, generic, deceptive, or identical or confusingly similar to an existing registration are liable to objection.
Startups, individuals and MSMEs pay a reduced government fee.

What happens if you do not do this
There is no penalty for not registering. The exposure is commercial: without registration you cannot sue for infringement, and someone else may register your name and require you to stop using it.
Using the ® symbol before registration is itself an offence — until the certificate issues, the correct symbol is ™.
What comes after
A registration is valid for ten years from the date of application and is renewable indefinitely in ten-year blocks. Renewal may be filed within six months before expiry, and there is a surcharge window after it.
We put the renewal date in your register the day the certificate issues, because ten years is long enough for everyone involved to have forgotten.
Questions people actually ask
How long does trademark registration take?
The application number arrives within days and you can use ™ immediately. Registration itself typically takes twelve to twenty-four months, driven by examination, journal publication and the four-month opposition period. Nobody can compress the statutory periods.
What is a class and how many do I need?
Classes group goods and services — forty-five in all. You need every class you actually trade in. Applying in classes you do not use adds fee without adding useful protection, and a mark can be removed for non-use.
Can I use the ® symbol straight away?
No. Until the certificate issues you must use ™. Using ® before registration is an offence under the Trade Marks Act.
What happens if my application is objected to?
The examiner issues a report and you file a reply, sometimes followed by a hearing. Objections are common and frequently overcome. Our Standard package includes one objection reply; the Premium package includes hearing representation.
Is a search really necessary before filing?
Yes. Filing over an existing similar mark wastes the fee and the time, and can invite opposition. The search is the cheapest part of the process and the part that most changes the outcome.
Does registration protect me outside India?
No. Trademark rights are territorial. Protection abroad requires filing in each country or through the Madrid Protocol.
What if someone opposes my mark?
Opposition must be filed within four months of publication. It becomes a contested proceeding with evidence and a hearing, quoted separately from registration.
